Cloudflare

We use the “Cloudflare” service provided by Cloudflare Inc., 101 Townsend St., San Francisco, CA 94107, USA. (hereinafter referred to as “Cloudflare”).

Cloudflare offers a content delivery network with DNS that is available worldwide. As a result, the information transfer that occurs between your browser and our website is technically routed via Cloudflare’s network. This enables Cloudflare to analyze data transactions between your browser and our website and to work as a filter between our servers and potentially malicious data traffic from the Internet. In this context, Cloudflare may also use cookies or other technologies deployed to recognize Internet users, which shall, however, only be used for the herein described purpose.

The use of Cloudflare is based on our legitimate interest in a provision of our website offerings that is as error free and secure as possible (Art. 6(1)(f) GDPR).

Storage duration

General information on the legal basis for the data processing on this website

Recipients of personal data

In the scope of our business activities, we cooperate with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only disclose personal data to external parties if this is required as part of the fulfillment of a contract, if we are legally obligated to do so (e.g., disclosure of data to tax authorities), if we have a legitimate interest in the disclosure pursuant to Art. 6 (1)(f) GDPR, or if another legal basis permits the disclosure of this data. Sentry

We have integrated Sentry on this website. The provider is Functional Software Inc., 45 Fremont Street, 8th Floor, San Francisco, California 94105, USA.

Sentry is an open-source bug tracking service that allows us to monitor and fix bugs and crashes anywhere in a web-based software in real time.

Sentry is used on the basis of Art. 6 (1)(f) GDPR. The website operator has a legitimate interest in the error-free functioning of its own website.

6. eCommerce and payment service providers

Processing of Customer and Contract Data

We collect, process, and use personal customer and contract data for the establishment, content arrangement and modification of our contractual relationships. Data with personal references to the use of this website (usage data) will be collected, processed, and used only if this is necessary to enable the user to use our services or required for billing purposes. The legal basis for these processes is Art. 6(1)(b) GDPR.

The collected customer data shall be deleted upon completion of the order or termination of the business relationship and upon expiration of any existing statutory archiving periods. This shall be without prejudice to any statutory archiving periods.

Data transfer upon closing of contracts for services and digital content

We share personal data with third parties only if this is necessary in conjunction with the handling of the contract; for instance, with the financial institution tasked with the processing of payments.

Any further transfer of data shall not occur or shall only occur if you have expressly consented to the transfer. Any sharing of your data with third parties in the absence of your express consent, for instance for advertising purposes, shall not occur.

The basis for the processing of data is Art. 6(1)(b) GDPR, which permits the processing of data for the fulfilment of a contract or for pre-contractual actions.

Payment services

We integrate payment services of third-party companies on our website. When you make a purchase from us, your payment data (e.g. name, payment amount, bank account details, credit card number) are processed by the payment service provider for the purpose of payment processing. For these transactions, the respective contractual and data protection provisions of the respective providers apply. The use of the payment service providers is based on Art. 6(1)(b) GDPR (contract processing) and in the interest of a smooth, convenient, and secure payment transaction (Art. 6(1)(f) GDPR). Insofar as your consent is requested for certain actions, Art. 6(1)(a) GDPR is the legal basis for data processing; consent may be revoked at any time for the future.

Google Pay

7. Processing within the HDR HERO application

The following notes supplement the general information above with the data processing that takes place specifically when operating the “HDR Hero” web application (after sign-in). No data protection officer is required by law; the thresholds of § 38 BDSG (generally at least 20 persons permanently engaged in processing) are not met.

We have concluded a data processing agreement pursuant to Art. 28 GDPR with all of the processors named below. Where a service acts as an independent controller (maps service, see below), this is indicated separately there.

Account, registration and contract performance (Supabase)

To use the service you create an account. We process your email address, your name or display label, optionally company and VAT ID, and the projects you create including property labels and addresses. Authentication and database are operated by the provider Supabase on servers in the EU (Frankfurt region). The legal basis is Art. 6(1)(b) GDPR. Billing-relevant data is retained in line with statutory periods (§ 147 AO, § 257 HGB; up to ten years). A data processing agreement is in place with the provider.

Image upload, storage and image processing

The exposure brackets you upload and the result images generated from them are stored with the object storage provider Cloudflare R2 (Cloudflare, Inc.) on servers in the EU. For image processing we use the services Photomatix (HDRsoft) and OpenAI. Individual processing steps may take place in a third country (in particular the USA); the transfer is safeguarded by appropriate safeguards, in particular the EU standard contractual clauses (Art. 46 GDPR). We strip technical metadata (e.g. EXIF/location data) from the result images. Your images are not used to train AI models. The legal basis is Art. 6(1)(b) GDPR.

Address entry (maps service)

For convenient entry of property addresses we use Google’s Places service (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Requests run exclusively server-side through us – your browser does not contact Google directly, and no Google scripts or cookies are loaded in your browser. Only the address string you enter is transmitted to Google; the search is limited to Germany, Austria and Switzerland. For this service Google acts as an independent controller (not a processor); any transfer to the USA is safeguarded by standard contractual clauses. The legal basis is Art. 6(1)(b) and (f) GDPR.

Transactional emails

For contract-related messages (e.g. confirmations, notice that results are ready, password reset) we send emails via the provider Brevo (Sendinblue SAS, France) with data processing in the EU. Your email address and the respective message content are processed. A data processing agreement is in place with the provider. The legal basis is Art. 6(1)(b) GDPR.

Newsletter

If you subscribe to our newsletter, we use the double opt-in procedure: after your sign-up we send an email to the address provided asking you to confirm. We only add you to the distribution list after your confirmation. We process your email address and the time of sign-up and confirmation (logged as proof). The legal basis is your consent under Art. 6(1)(a) GDPR. You can withdraw your consent at any time with effect for the future, e.g. via the unsubscribe link in every newsletter email. Sending and recipient management is handled by the provider Brevo (Sendinblue SAS, France) with data processing in the EU; a data processing agreement is in place with the provider.

Cookies and local storage in this application

Within the application itself we use only technically necessary cookies or local storage: a session/authentication cookie (login), storage of your language selection and – for protected share links – a cookie for password confirmation. These are strictly necessary for the service you expressly requested (§ 25(2) TDDDG) and do not require consent; a cookie banner is therefore not required. Fonts are self-hosted from our server (no retrieval via an external font CDN).

Reach measurement (visitor statistics)

To determine rough visit figures (e.g. page views and the approximate number of visitors per day) we measure the reach of our website ourselves and without any third-party services. In doing so we set no cookies and store no IP address in plain text. From your IP address, your browser identifier (user agent) and the current date we derive a pseudonymous, daily-rotating check value (hash) that rules out recognition across days and cannot be traced back to you. We store only the requested page path, the timestamp and this check value. The data remains on servers in the EU and is automatically deleted after 90 days. On our marketing pages we additionally collect – likewise anonymously, without cookies and without the check value mentioned above – aggregate interaction statistics: where visitors click and how far and how long sections of a page are viewed (click and scroll heatmap). Only anonymous position and timing values are recorded (no input-field contents, no identity); this data too remains in the EU and is deleted after 90 days. The legal basis is our legitimate interest in a statistical analysis and the technical optimization of our service (Art. 6(1)(f) GDPR). As neither cookies are set nor information is read from your end device, no consent under § 25 TDDDG is required for this.

Data export and deletion of your account

You can trigger a data export and the deletion of your account at any time directly in your account settings. Deletion also covers the images stored in the application; statutory retention obligations (e.g. for invoices) remain unaffected. Your further data subject rights (see section 3) remain unaffected.
